Welcome to Elegance Tiles and Flooring. These Terms of Sale and Service (“Terms”) govern your purchase of products and use of services from Elegance Tiles and Flooring (“we,” “our,” or “us”). By placing an order or using our services, you agree to these Terms. Please read them carefully.
1. Scope
These Terms apply to all sales of products and services offered by Elegance Tiles and Flooring through our website, physical stores, or other sales channels. Additional terms may apply for specific products or services, which will be communicated to you at the time of purchase.
2. Products and Pricing
2.1. Product Descriptions
We strive to ensure that product descriptions, images, and specifications are accurate. However, variations may occur due to factors such as screen settings or material differences. Natural products like wood and stone will inherently have variations in color, texture, and pattern. These natural characteristics are not defects, and we are not responsible for such variations.
2.2. Pricing
All prices are listed in [Insert Currency] and are subject to change without notice. Taxes, shipping, and handling fees are not included in the listed price unless specified.
2.3. Availability
Product availability is subject to stock levels at the time of order. If an item is unavailable after your order is placed, we will notify you and offer a replacement, backorder, or refund.
3. Orders and Payment
3.1. Placing an Order
To place an order, you must provide accurate personal and payment information. Orders are subject to acceptance, and we reserve the right to refuse or cancel orders for any reason, including suspected fraud or errors in pricing.
3.2. Payment Policy
All payments are due at the time of placing an order. This applies to both materials and services provided. Any payment delays will incur a 1.5% monthly interest on the outstanding balance. Additionally, Elegance Tiles and Flooring reserves the right to opt for a construction lien or mechanic’s lien if payments are not made in a timely manner, as permitted by law.
3.3. Card Payment Fees
A service fee or card fee will be applied when payments are made using American Express (AMEX) or Mastercard. The exact fee will be communicated during the transaction.
3.4. Deposits
All deposits are non-refundable, including those for custom orders, special orders, or reserved installations.
3.5. Payment Methods
We accept Visa, Mastercard, American Express, cash, check, debit. Payment must be
completed at the time of purchase. For all orders, we require a deposit.
3.6. Confirmation
You will receive an order confirmation once your order is processed. If you do not receive a confirmation, please contact us.
4. Delivery and Shipping
4.1. Delivery Terms
- Delivery Location: Deliveries will be placed inside the garage or at the front porch of the delivery address. We are not responsible for taking the materials inside the home or any other area of the property.
- Inspection at Delivery: It is the customer’s responsibility to inspect the material upon delivery. Any concerns or issues must be reported at the time of delivery or before installation. Once the material is delivered and/or installed, we are no longer responsible for any defects or damages.
4.2. Delivery Times
Delivery times vary based on product availability and destination. Estimated delivery dates will be provided at checkout. Delays due to unforeseen circumstances (e.g., weather, shipping carrier issues) are not our responsibility.
4.3. Shipping Fees
Shipping fees are calculated at checkout and depend on the delivery location, weight, and dimensions of the package.
5. Returns, Refunds, and Exchanges
5.1. Returns
- Within 15 Days: Stock items returned within 15 days of purchase may be accepted, subject to a restocking and handling fee. Items must be unused, undamaged, and in their original unopened packaging.
- Custom Orders: Custom or special orders, including sold hardwood and other customized items, are non-returnable under any circumstances.
- Non-Returnable Items: All clearance merchandise, remnants, and merchandise marked “as is” or “Final Sale” are sold without warranty and may not be returned for any reason.
- Receipt Requirement: The customer must present the original receipt to qualify for a refund or in-store credit.
5.2. Refunds
- Credit Card Purchases: Refunds for credit card transactions will be issued to the original credit card used for the purchase.
- Cash or Check Transactions: Refunds for cash or check transactions will be issued via a corporate check. Please allow 14 days for processing.
5.3. Exchanges
Exchanges are subject to product availability. Contact us to arrange an exchange.
6. Warranty and Liability
6.1. Warranty on Products
We offer a warranty against manufacturing defects on eligible products. The warranty does not cover:
- Damages caused by misuse, improper installation, or wear and tear.
- Natural variations in wood, stone, or other natural materials.
6.2. Installation Warranty
Installations are covered by a one-year workmanship warranty, as outlined in the renovation contract provided before the start of the project. Please retain a copy of the renovation contract for your records.
6.3. Liability
Our liability is limited to the purchase price of the product or service. We are not responsible for indirect, incidental, or consequential damages arising from the use of our products or services.
7. Installation and Services
7.1. Installation Services
If you book installation services through us, it is your responsibility to ensure the site is ready for installation on the agreed date. Additional charges may apply for site preparation or delays.
7.2. Service Guarantee
We guarantee the quality of our installation and related services. If issues arise, notify us within 72 hours to request a review or correction.
8. Cancellations
- Cancellation Timeline: Cancellations for any orders or services must be made at least 7-10 business days prior to the scheduled delivery or service date.
- Cancellation Fee: A cancellation fee will be applied for any canceled orders or services.
9. Force Majeure
We are not liable for delays or failure to fulfill orders due to events beyond our control, including but not limited to natural disasters, labor strikes, supply chain disruptions, or government actions.
10. Governing Law and Disputes
These Terms are governed by the laws of Ontario. Any disputes will be resolved through Preferred Dispute Resolution Method.
11. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting on our website. It is your responsibility to review the Terms periodically.
